Family violence covers a broad range of controlling behaviour—often of a physical, sexual, and/or psychological nature—typically involving fear, harm, intimidation and emotional deprivation. The result of the case is that the civil-remedy provisions in the original statute should fall under the purview of the states, rather than the federal government. Each case of domestic and family violence involves a unique and complex series of facts that must be considered as a whole in order to understand the victim’s experience of violence, and to respond appropriately to risk of future violence and perpetrator accountability.
